ARS 13-1406 Sexual Assault

A person commits sexual assault in Arizona by intentionally or knowingly having sexual intercourse or oral sex without the consent of the other person.  This is an incredibly serious charge.  It’s a class 2 felony, but has its own specific sentencing requirements, unlike a typical class 2 felony.  If convicted, you face a mandatory prison sentence of 5.25 – 14 years for a first offense, and that is what’s typically called “flat time”, meaning the sentence cannot be reduced by things like good behavior.  Sex offender registration is also mandatory.  The stigma of such a conviction can have crippling collateral consequences on many aspects of your life.

Sexual assault charges can be incredibly complex, involving things like DNA evidence, victimology experts, and medical records.  So often these charges come down to the claim that the act was consensual, and to make that claim effectively, you need a skilled attorney with a background defending and prosecuting sex offenses to advocate on your behalf.

False sexual assault accusations happen with alarming regularity, and mere accusations can have a devastating impact on your life.  If you find yourself in this position, it’s crucial you call the attorneys at BC Law Group in Arizona for a free consultation as soon as possible to build a strategic defense and aggressively defend your freedom.
